The report comes to the conclusion that financial participation is <strong>important for the acceptance<\/strong>z, but the current <strong>\"Patchwork\" of state laws jeopardises economic efficiency,<\/strong> the <strong>Speed <\/strong>and the <strong>Fairness<\/strong> in the expansion of wind and solar energy in Germany.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What the federal and state governments have regulated so far<\/strong><\/h3>\n\n\n\n<p>With <strong><a href=\"https:\/\/www.buzer.de\/6_EEG_2023.htm\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 6 EEG <\/a><\/strong>only one <strong>Voluntary framework for payments to local authorities<\/strong> (e.g. for wind farms and ground-mounted PV installations) in order to avoid constitutional risks. Binding obligations towards municipalities and citizens are created primarily at state level, based on a <strong>Opening clause in the EEG<\/strong> and a <strong><a href=\"https:\/\/www.bundesverfassungsgericht.de\/SharedDocs\/Entscheidungen\/DE\/2022\/03\/rs20220323_1bvr118717.html\" target=\"_blank\" rel=\"noreferrer noopener\">Judgement of the Federal Constitutional Court<\/a><\/strong>which generally permits such models.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Heterogeneous state laws make an overview difficult<\/strong><\/h3>\n\n\n\n<p><strong>Several countries<\/strong> (including Mecklenburg-Western Pomerania, Brandenburg, NRW, Saxony, Saxony-Anhalt, Saarland) have now <strong>Own participation laws with different models and levels<\/strong> introduced. Depending on the federal state, the instruments range from <strong>fixed payments to municipalities<\/strong> about <strong>subsidised citizen participation<\/strong> up to <strong>Obligations to participate<\/strong> also for ground-mounted PV systems - <strong>without standardised upper limits <\/strong>or clear definitions of the beneficiary groups.<\/p>\n\n\n\n<p>One <strong>Overview of the individual state participation laws<\/strong> you will find <strong><a href=\"https:\/\/sonne-sammeln.de\/en\/kommunen\/beteiligung-auf-laenderebene\/\" target=\"_blank\" rel=\"noreferrer noopener\">here on SonneSammeln<\/a><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The critical points from the perspective of the experts:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Economic efficiency:<\/strong> High or cumulative participation obligations can make projects so expensive - especially in the tendering system - that they are no longer competitive, while construction can continue in other countries with lower requirements.<\/li>\n\n\n\n<li><strong>Legal and planning uncertainty:<\/strong> Different regulations and unclear terms increase the legal burden for project developers and local authorities and discourage smaller players in particular.<\/li>\n\n\n\n<li><strong>Unclear effect<\/strong>The report emphasises that more money does not automatically mean more acceptance and that financial participation without dialogue, fair planning and local participation can easily be perceived as \"hush money\".<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What the authors recommend<\/strong> <\/h3>\n\n\n\n<p>Instead of ever new and stricter national rules, the study argues in favour of<strong> Clearer guard rails in the EEG<\/strong>. So that participation <strong>not a hidden special levy <\/strong>they recommend permissible forms of participation, upper limits on the load per kWh and clearly defined favoured groups.
